Terms of Use and Privacy Policy

This document uses feminine pronouns for convenience but applies equally to all genders.

TODO provides its users with a platform consisting of an application and website (hereinafter: "the Site") for managing tickets, teams, customers, and accounts (hereinafter: "the Services").

Use of the Site and Agreement to Terms

This document outlines the terms of use and privacy policy of the Site (hereinafter: "the Policy") to present TODO's practices regarding user privacy, the use of personal information, and how TODO uses information provided by users. Please note that any use of the Site constitutes your agreement to the terms of the Policy. TODO reserves the right to change, add, and/or delete any of the Policy terms at any time without obligation to provide prior or subsequent notice. Therefore, it is recommended to review this document periodically.

By using the Site, you declare and commit that you are at least 18 years old, or alternatively, that you are using the Site with the permission of a parent (or guardian) and their full agreement to this Policy. Please read this Policy carefully before accessing and using the Services.

Privacy Policy

TODO respects your privacy and is committed to upholding accepted privacy protection standards. The use of personal information provided by you during your use of the Site will be solely in accordance with this Policy or as required by TODO under Israeli law.

'Personal Information' in this Policy refers to information about an individual that identifies them or could reasonably be used to identify them, and/or information related to an individual that may be of a private or sensitive nature. Personal Information does not include information that has been anonymized.

The Services on the Site require registration and/or direct submission of personal information by you, as detailed below:

By using the Site, you agree that the information provided by you will be stored in TODO's databases for operational purposes, to manage and improve the service, and for marketing and statistical purposes. It is clarified that you are not obligated to provide us with the details specified above by law, and their submission depends solely on your free will and consent to receive TODO's services. By using the Site, you waive any claim or lawsuit against TODO and its representatives on this matter. Please note that without providing certain details, we will not be able to provide you with some or all of the offered Services.

You commit to providing your personal information in a reliable and accurate manner, only in your own name and for yourself, and not for others or any third party. TODO bears no responsibility for the accuracy, quality, and reliability of the information, and the parties cannot complain against it.

The Site uses various automated tools for operational purposes and to improve the user experience by collecting non-identifiable data. This information includes, among other things, IP address and location of the device used to access the Site. In addition, TODO uses information files such as "Cookies" which allow, among other things, to save the details you entered in various forms, thus saving you the time of re-entering details on your next visit. This information is encrypted, and TODO takes precautionary measures to ensure that only TODO representatives or those on their behalf can access and understand the information stored in them. By agreeing to the terms of this Privacy Policy, you agree to the use of the described technologies and other technologies, as they may be from time to time, for similar purposes, including the use of information that will be stored through them for the purpose of identifying you according to them.

TODO is careful not to transfer identifiable personal information about you to third parties, except in one or more of the following cases:

1. When performing certain actions within the Services, information may need to be transferred to service providers to complete the action and/or those carrying out the action, and to parties related to that action - such as a credit clearing company, a company issuing receipts, and so on. The specific information for the specific engagement between the service requester and the service provider will be kept by us, and its transfer to the relevant parties for the completion of the actions will be subject to your consent and desire to receive the service and/or transfer the information. TODO has no responsibility regarding this matter and matters related to the transfer of information, and you waive any claim against TODO in this regard.
2. In the case of a legal dispute between you and TODO that will require the disclosure of your details and/or if you perform actions contrary to the law on the Site and/or in case a judicial order is received instructing so.
3. For conducting statistical analyses and transferring statistical or other information to third parties. This information will not allow your personal identification. Nothing in the above detracts from our right to transfer to third parties non-personal information that does not directly identify you by name and/or your identity details.
4. In case it is found that you have violated one or more of these terms of service and/or in cases where you perform or attempt to perform actions contrary to the terms of use or any law.
5. In the event that the company is sold, transfers, and/or merges its activity with another corporation, provided that the new information recipient accepts these terms of use in full.

Your Rights Regarding the Information

In accordance with the provisions of the Privacy Protection Law, 5741-1981, you, or someone on your behalf, are entitled to review information about you that is in TODO's databases, and you also have the right to request TODO to correct this information if it is incorrect, incomplete, or inaccurate, and even to delete it in certain cases. To exercise this right, please contact TODO's customer service using the contact details at the bottom of this document.

Even if the information is removed or corrected, or your request is accepted in any other way, TODO may in any case retain information necessary for us to manage the Site, including information necessary to protect and maintain legal rights, or to comply with regulatory requirements, prevent fraud or deception, and enforce this Privacy Policy and the Site's terms of use.

Copyright and Prohibited Uses

The Site and the content appearing on it, including, without limiting the generality of the above: Site design, graphics, logos, data, designs, illustrations, images, maps, text, graphics, etc., are protected by copyright laws in Israel, international conventions, and copyright laws of other countries, and in any case belong to TODO or other third parties. Use of this information, without express prior written consent from TODO, is strictly prohibited and will constitute copyright infringement.

Moreover, unless explicitly stated or marked, TODO is the owner of all rights related to the content on the Site. You may not use, copy, duplicate, reconstruct, process, distribute, display, or publish content from the Site or make any use of it for commercial or private purposes, by you or by another on your behalf, unless TODO or someone on its behalf has explicitly permitted it in writing and in advance.

The user commits not to perform and not to attempt to perform any change to the Site and/or copying and/or downloading of material stored on the Site by any method, algorithm, or similar manual process, and/or not to perform any action that may harm TODO's copyrights, harm the privacy of other users, and/or change information on the Site and/or harm the Site and/or its users.

All rights (whether registered and/or unregistered and/or in registration processes), in connection with the information and/or the Site, including, without limiting the generality of the above: copyrights, domain name, trade secrets, designs, the manner of presentation and design of the Site, and any matter or detail related to the Site, are the exclusive property of TODO and the use of all rights mentioned is permitted to it exclusively and/or in accordance with the license terms granted to it.

Without receiving explicit, written permission in advance from TODO, you are not allowed to perform the following actions or acts:

1. Commercial use of the Site and/or its content and/or use of the Site and/or its content for creating a database and/or collection;
2. Copy, reconstruct, modify, process, translate, reverse engineer, distribute, transmit, display, perform, reproduce, publish, and store the Site's content, in whole or in part;
3. Operate or allow the operation of any computer application or any other means for the purpose of automatic search, scanning, copying, or retrieval of the Site's content;
4. Display content from the Site within a visible or hidden frame (iframe) or display the Site's content in any way that changes its original design on the Site and/or omits anything;
5. Disrupt or violate any right of another user on the Site and/or harm the dignity or privacy of another user and/or any other harm;

Failure to comply with these limitations may lead to prevention of your access to the Site and may even expose you to civil and/or criminal liability under any law.

Information Security

TODO does everything in its power and uses advanced technological and organizational security measures to secure the Site and its communication channels and the information under its control, against accidental or intentional exploitation, loss, destruction, or against access by unauthorized or unauthorized persons.

However, TODO cannot guarantee the security of information and its preservation in an absolute manner and does not guarantee that the Site or its use will be completely immune to unauthorized access to information or content stored on it. Therefore, it is hereby clarified that TODO will not be responsible and will not bear any responsibility in case of intrusion or breach and/or any damage caused due to the use of the Site and/or the content displayed on it and/or the services accompanying it, by the Site user or anyone on their behalf.

Miscellaneous

These terms of use (or any of the provisions in them) do not create and will not be interpreted as creating any partnership, employer-employee relationship, agent, or representative between you and TODO or anyone on its behalf in any way.

The use of the Site and/or any claim, demand, and/or request arising from this use will be governed solely by the laws of the State of Israel, and the place of jurisdiction will be in the Tel Aviv court, and the substantive and procedural law will be Israeli law, subject to TODO's right to take legal proceedings in the courts where the user's address and/or place of business and/or assets or part of them are located, at the company's discretion.

If any of the terms of use is found to be illegal, void, or unenforceable for any reason, this term will be deleted from the terms of use and its deletion will not affect the legality and validity of the remaining terms of use.
